Des Plaines, Illinois, Cancer and Social Security Disability Lawyers

Cancer is one of the greatest health fears of most Americans. According to the American Cancer Society there were more than 1,360,000 reported cases of cancer in 2004 and more than half a million cancer related deaths. At the Des Plaines, Illinios, law firm of Jeffrey A. Rabin & Associates, Ltd., we serve SSDI and SSI claimants in Chicago, Illinois, and across the nation. Our firm has effectively assisted numerous clients in pursuing successful Social Security Disability claims related to Cancer.

Chicago Lawyers Experienced at Handling SSDI and SSI Claims Related to Cancer

The Social Security Administration (SSA) recognizes cancer as causing impairments that qualify for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI). However, the SSA examines each case individually to determine whether the effects of the cancer or the cancer treatment will last or can be expected to last "not less than 12 months or result in death."

Cancer Treatment and SSDI and SSI Claims

The Social Security Administration assumes that the effects of cancer treatment will only last for a limited duration, and not meet the one year requirement. However, each individual reacts to surgery, irradiation, chemotherapy, hormones, immunotherapy, and bone marrow or stem cell transplantation differently. Additionally, if after treatment malignancy persists, progresses, or recurs, the SSA will approve SSDI or SSI insurance benefits.

The Social Security Administration classifies cancer as a Malignant Neoplastic Disease. Simply stated, it is abnormal cancerous growths, such as tumors. In determining long-term disability insurance benefits for cancer the SSA considers four factors:

  • Origin of the malignancy
  • Extent of involvement
  • Duration, frequency, and response to antineoplastic therapy. Antineoplastic therapy means surgery, irradiation, chemotherapy, hormones, immunotherapy, and bone marrow or stem cell transplantation
  • Effects of any post-therapeutic residuals

Our lawyers concentrate on handling Social Security Disability Insurance and Supplemental Security Income claims. We understand what documentation is necessary to prove disabilities under the Social Security Administrations guidelines.

Applying for SSDI or SSI Benefits in Relation to Cancer

The Social Security Disability application process is intended to allow claimants to handle claims without legal counsel, especially as they relate to listed impairments such as lymphoma, leukemia, breast cancer, skin cancer, brain cancer, and thyroid cancer. However, only 35% of all Social Security Disability applications are approved at their initial filing. As experienced Social Security Disability lawyers, we understand the application process, what medical information needs to be presented to get Social Security Disability benefits, and how to appropriately fill out application forms for cancer related SSDI or SSI applications. In addition, we have extensive experience handling Requests for Reconsideration and hearings before Administrative Law Judges (ALJ) when SSDI and SSI benefits are denied.
